Murders at Stringy Bark Creek in the Wombat Ranges 26/10/1878 I was then stationed at Learmonth, in the South-Western district at the time of the murders and then applied to join the humt for the KellyGang.(RC7774.7277)

I arrived at Benalla on 18/11/1878(RC7774.7277 )

I went out with many of Ass Com Nicolson's search parties. We would camp, and have tea, put out the l fires where we camped, catch all our horses again, and remove in the darkness of night to some other place, perhaps a mile away. There were usually 6 or 8 police in a search party. . I simply went where the others led to. I had no information about the KellyGang.(RC7774.7285 )

Euroa Robbery 10/12/1878 I was involved in search parties hunting the KellyGang after the Euroa robbery with Const Johnson's party. (RC7774.7295 ) see other members. (RC5964) Jerrilderie Robbery 10/2/1879 I thought of arresting John Sherriitt for stealing a sheep. He had a skin (JJK)

I went out with Mr Hare into the Warby Ranges (RC7774.7293 )

On about 1/2/1879 I was watching for the KellyGang on the banks of the Ovens River with Sup Sadleir and Sup Hare.(RC7774.7569 )

Cave Party

I also went off with Sup Hare to the first cave party watching Mrs. Byrne's house. It was not properly speaking a cave, but simply a blind gully, and we planted under some rocks.

Mrs Byrne came down on the cave one day when I was on guard. I presume she knew, as SConst Mills spoke to her. I saw her approaching the cave, and told Mr Hare, and he sent Mills to stop her. (RC7774.7297 )

Cave Party

I was a member of the party working with Aaron Sherritt in the cave party watching Mrs Byrne's home.We got our provisions from the Sherritt home (RC7774.7320) See also (RC1717)

Just before Aaron got married I told Det Ward that I was concerned that Aaron did not attend so punctually to his duties as he had been before and that we had been discovered. . The Sherritt family were rowing among themselves, and I wanted to get out of it.(RC7774.7514)

Mrs Sherritt, senior, has made statements to me, which I afterwards reported to Det Ward, which would lead me to believe that the Byrne family were aware of our presence. Det Ward was concerned that I even spoke to her about this matter. But then Ward denied that I ever told him about this conversation. I also reported on the conduct of Aaron Sherritt and he denied that also. (RC14122) I stayed at Beechworth until 2/4/1880 when the cave party ended (RC7774.7509)

I heard from some of the men that they were called on to make reports, and I went to SConst Mullane and asked him if he wanted a report frm me; I had never done the same thing, and there must be some object, for it; and he simply told me to go and do as I was told. He said that he had got a telegram from Det Ward telling us to make out reports, but would not show it to me. (RC7774.7520 ) (see Det Ward's version at RC13858 and RC14115)

I wrote out the first version of my report to Ass Comm Nicolson. SConst Mullane commented on it and asked me to write a second report. I then gave both reports to Mullane. They were later returned to me by Det Ward and he asked me to produce a third report. (RC7774.7531) see also (RC5440)(RC5886)(RC7537)(RC12118) (RC13558) (RC14113) (RC14134)

The third report says; "Report of Constable Daniel Barry, 2710, relative to special duty near Beechworth.-I beg to report, for the information of the Assistant-Commissioner of Police, that I have been engaged on special duty from 3rd December last to 17th March last, watching Byrne's house at Sebastopol. During that time, so far as I could judge, none of that family were aware of our being in the vicinity. The instructions received from the Assistant-Commissioner of Police were strictly carried out, and the greatest possible precautions were used by the party to prevent our being discovered.-DANIEL. BARRY, 2710" (RC7774.7636)

Nicolson replaced by Hare 2/6/1880 I spent only one or two nights at Aaron Sherritt's home. I was suffering from rheumatism, caused by being so long in the cave, and could not do the work. (RC7774.7333)

A few weeks before the Glenrowan siege Consts Cornelius Ryan and Wallace and I were sent to watch the Kelly home (RC5817)

I started to get ready to catch the special train in Benalla at about 3pm (RC8030) (FH)

Arrive at Glenrowan

I arrived at about 2am with Sup Hare' party. I started to travel down on the pilot engine. The traffic manager ordered me down off the engine, and to go down into the van connected with it. (RC7774.7350)

When the train was stopped by Mr Curnow, Consts Gascoigne, Phillips and I went from this train to the pilot engine, which was perhaps a quarter of a mile ahead. The two trains were linked up.(RC7774.7357)

When we got to the platform and set to saddle the horses in case we had to gallop after them and pursue them, as we understood they were at Glenrowan.

Begining of the siege

Sup Hare went down to the stationmaster's home and spoke to his wife. Const Bracken came up after Sup Hare returned and while we were unloading the horses SConst Kelly said, "Let them go, and come on," and we rushed for Mrs. Jones's place. Mr. Hare sang out, "Come on," and went through the wicket gate. There were four or five of us with Mr. Hare, and when within about 25 yards of the front verandah we were fired on. We returned the fire, and it was kept up for perhaps five minutes without intermission. Sup Hare,Const Phillips, Gascoigne, Kirkham, and myself were first through the wicket gate. (RC7774.7365)

After the first shots were fired I took up position at the Benalla end of the Inn (RC(See also RC7774.7370))

SConst Kelly placed me at the back on guard, for fear anyone should come from the back.(RC8049) (RC9674)

The next officer, to the south of me, more towards the railway line was either Const Kirkham or Gascoigne. (RC7774.7375)

No one gave me any orders, but SConst Kelly came round to me with ammunition, and told me to keep my position, as it was a good one. That was about 1/2 an hour after the first shot was fired. (RC7774.7392)
