Early in the day Ned Kelly sold a mare to Frank Harty in Winton and an other horse to Joseph Ryan of Lake Rowan.

Const Alexander Fitzpatrick wanted to go to Greta to arrest Kellys, sought Sgt Whelan's consent after he returned from Cashel.
1 pm Healy   Const Healy returned to Benalla
2 pm     Fitzpatrick left Benalla to relace Const Strahan at the Greta police station
      Fitzpatrick had been drinking at Lindsay's shanty at Winton and at Brickey Williamson's place

  Fitzpatrick got to the Kellys place at Eleven Mile Creek and spent 'about an hour' talking to Mrs Kelly, Grace and Kate, hoping that Dan would turn up.

Bricky Williamson was heard chopping wood, splitting fence rails

6 pm

    Two horsemen turned up Bill Skillian? and Dan Kelly. Dan agreed to be arrested but went inside to have some dinner first. Tom Lloyd admitted that he was there

Next according to Fitzpatrick, Ned Kelly turned up and shot him in the wrist. Fitzpatrick cut out the bullet and Mrs Kelly bandaged up the wound

  Winton By about 10pm Fitzpatrick was back at Lindsay's shanty after being shot by Ned Kelly. Lindsay rebandaged his hand
      The people at Mrs Kelly's home included, Mrs Kelly, Alice, John, Ellen, Grace, Kate, Dan and Ned Kelly?

Fitzpatrick Benalla Fitzpatrick returned to Benalla and saw Sgt Whelan, He was wounded and Whelan sent for Dr Nicholson
morning   Beanalla warrants were issued for the arrest of Ned Kelly, Dan Kelly, Mrs Kelly and Brickey Williamson for the attempted murder of Fitzpatrick
