In October [[1874-1877 Events|1877]] horses stolen some time before from [[Whitty|James Whitty]] were found in [[Howlong|Howlong]]. William Baumgarten was found guilty of stealing the horses from Whitty and others near Greta.

My friends [[William Baumgarten|William]] and [[Gustav Baumgarten|Gustav]] Baumgarten, John [[John Studders|Studders]] and I were charged with receiving the animals knowing that they had been stolen. While I knew [[Ned Kelly|Ned Kelly]] I was not involved in this matter and the case against me was adjourned. Was Ned Kelly the Thompson who the police could not find. Eventually [[William Baumgarten|William]] Baumgarten and I were taken to trail in the Supreme Court in [[Beechworth Court|Beechworth]] in October 1878 before Mr Justice [[Redmond Barry|Barry]]. We were found guilty and I received 6 years in goal. William got 4 years
