RUTHERGLEN, Tuesday

At the police court to-day, before Captain Burrowes, PM, and Mr C H Morris, JP, Michael Murphy was charged under the Amended Marriage Act with desertion of his wife and family by going out of Victoria . The offence renders the accused liable to a term of 12 months' imprisonment, with hard labour, and is the first of its kind tried in the North-Eastern district. Murphy, who is the proprietor of the Woolpack Hotel, [[Corowa|Corowa]], was arrested on warrant on Monday, and brought over to Rutherglen. The desertion took place some 12 months, ago, and there are four children. [[Ellen Sherritt|Mrs Murphy]] was the widow of Aaron Sherritt, who was shot by the Kelly gang some four months after their marriage. Mr Edmondson, who appeared for the accused, applied for a remand for 14 days, owing to the fact that he had not had sufficient time to prepare the defence. The presiding magistrate granted the remand.
