The Police Commission yesterday took further evidence of John Sherritt, and also examined Mr Bolam , acting-Secretary for education, with reference to the position in the deportment of Mr James Wallace, state school teacher, and a previous witness.
It was thought desirable by the commission that the evidence of these two witnesses should not be published. We are at liberty to mention, however, that John Sherritt stated that his late brother, Aaron Sherritt, had been seen by the outlaws, or some sympathisers, in company with a party of police about a month before he was murdered, and that that circumstance first led the outlaws to suspect that he was in communication with the police. This witness also alleged that Dan Kelly had called at his house about 6 o'clock one night, and left word that he would call again the same nigh at 8 o'clock . The witness at once gave information to Mr Nicolson and Detective Ward at Beechworth, and the police could easily have been out at his house at 8 o'clock , but no use was made of his information, and the whole gang did turn up at his house about 8 o'clock . Mr Nicolson postponed his cross-examination of this witness. Mr. Bolan stated in his evidence that the Education department had received such information about Mr Wallace during the time the Kelly gang were at large that they had deemed it necessary to remove him from the North eastern district. The commission adjourned until Tuesday.
